Terms of Service

Please read these Terms of Service ("Terms") carefully before using GiftSentra. By accessing or using our app or website, you agree to be bound by these Terms. If you do not agree, do not use GiftSentra.

1 Acceptance of Terms

By creating an account or using GiftSentra (the "Service"), you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using GiftSentra on behalf of an organisation, you represent that you have authority to bind that organisation.

2 Description of Service

GiftSentra is a gift planning application that helps you track people, events, gift ideas, and wishlists. The Service includes:

• A web application accessible at giftsentra.com
• iOS and Android mobile applications
• AI-powered gift suggestions
• Product search across third-party retailers
• Calendar integration with Google Calendar and Microsoft Outlook
• Push notification reminders for upcoming occasions

3 Account Registration

You must create an account to use GiftSentra. You agree to:

• Provide accurate and complete information during registration
• Keep your login credentials secure and confidential
• Notify us promptly if you suspect unauthorised access to your account
• Be responsible for all activity that occurs under your account

We use Supabase to manage authentication. You may register using an email address or supported third-party sign-in providers.

4 Free and Premium Plans

GiftSentra offers both a free tier and a paid Premium subscription. Features available on each tier are subject to change. Premium features may include, but are not limited to, unlimited AI gift suggestions, increased product search results, and advanced calendar integration.

We reserve the right to modify, limit, or discontinue features of the free tier at any time.

5 Subscriptions, Billing & Cancellation

5.1 Subscription Plans

Premium access is available as a monthly or annual subscription, offered via:

• Stripe — for web app subscribers
• Apple App Store — for iOS subscribers
• Google Play Store — for Android subscribers

5.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

5.3 Cancellation

You may cancel your subscription at any time:

• iOS: Settings → Apple ID → Subscriptions
• Android: Google Play → Account → Subscriptions
• Web: Via the Stripe Customer Portal in your account settings

Cancellation takes effect at the end of the current billing period. You will retain Premium access until that date.

5.4 Refunds

Refunds are subject to the policies of the payment platform used. Please consult Stripe, Apple, or Google Play for their respective refund procedures. Refunds outside of these policies are not guaranteed.

5.5 Price Changes

We may change subscription prices with reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6 Acceptable Use

You agree not to use GiftSentra to:

• Violate any applicable law or regulation
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorised access to our systems or other users' accounts
• Scrape, copy, reverse-engineer, or attempt to circumvent any technical measures protecting any part of the Service
• Use the Service for any commercial purpose without our written consent
• Harass, impersonate, or harm other users

We reserve the right to suspend or terminate accounts that violate these rules.

7 User Content and Third-Party Data

7.1 Your Content

You retain ownership of all data you enter into GiftSentra, including gift ideas, wishlists, and event information ("User Content"). By using the Service, you grant GiftSentra a limited licence to store and process your User Content solely to provide the Service to you.

7.2 Data About Others

GiftSentra allows you to enter personal information about third parties (e.g. names, birthdays, interests of friends and family). You represent that:

• You have the right to enter and use this information
• You will not use GiftSentra to store data about individuals without a legitimate personal purpose
• You accept responsibility for ensuring this data is handled appropriately

7.3 No Sensitive Data

You agree not to enter sensitive personal data (e.g. financial information, medical data, government ID numbers) about yourself or others into GiftSentra.

8 AI-Generated Content

GiftSentra uses third-party AI services (including Cerebras and/or OpenAI) to generate gift suggestions. Use of AI-generated suggestions is also governed by our Privacy Policy. You acknowledge that:

• AI-generated suggestions are provided for informational and convenience purposes only
• We do not guarantee the accuracy, availability, or suitability of any AI-generated recommendation
• You remain responsible for all decisions and transactions resulting from AI recommendations
• We are not liable for outcomes arising from any purchase made based on AI suggestions
• AI providers may change over time and their output may vary

9 Product Search and Third-Party Links

GiftSentra displays product results sourced from third-party retailers and search APIs, including eBay, Amazon, Walmart, SerpAPI, and DataForSEO. Use of product search is also governed by our Privacy Policy. We:

• Do not sell, fulfil, or warrant any products displayed
• Are not responsible for the accuracy of pricing, availability, or product descriptions
• Are not liable for any transactions made on third-party websites

Links to third-party sites are provided for convenience. Their terms and privacy policies apply once you leave GiftSentra.

10 Calendar Integration

If you connect Google Calendar or Microsoft Outlook, you authorise GiftSentra to access your calendar data to identify gift-giving occasions. You may disconnect your calendar at any time from your app settings. We are not responsible for inaccuracies arising from calendar data synced into the Service.

11 Intellectual Property

GiftSentra and its content, features, branding, and technology are owned by GiftSentra and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

12 Privacy

Your use of GiftSentra is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

15 Account Termination

15.1 By You

You may delete your account at any time from the Profile screen (mobile) or account settings (web). Account deletion permanently removes your data as described in our Privacy Policy.

15.2 By Us

We reserve the right to suspend or terminate your account at any time if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

16 Changes to These Terms

We may update these Terms from time to time. The effective date will reflect the latest version. We will make reasonable efforts to notify you of material changes. Continued use of the Service after changes constitutes acceptance of the updated Terms.

17 Governing Law

These Terms are governed by the laws of New Zealand, subject to applicable local consumer protection laws in your jurisdiction.
